Public domain material
If we are correct in assuming that recorded material from 1964 not released prior to 2015 now has fallen into public domain, we are attempting to make some lists, based on material circulating on bootlegs that may now be exploited by anyone wishing to release their own Beatles albums.
We start it off with three lists of what is available in terms of studio outtakes from the ‘A Hard Day’s Night’ album, the ‘Beatles For Sale’ album and the various BBC programmes.

Everything in RED is covered by current copyright (either by CD, VHS or DVD release), everything in BOLD is in the public domain from the start of 2015.
Some material taken from the ‘Abbey Road Video Show’ is a subject of debate as this audio was played in public in 1983, this material is marked in BOLD and ITALICS.

Concerts
Then of course, there are the concerts. Many of The Beatles’ 1964 concert performances were recorded, some of them professionally for broadcasting purposes.

- January 16 Two concerts at L’Olympia Theatre, Paris – both recorded by Europe 1 and broadcasted on Musicorama.
- April 26 NME Poll Winners’ Concert. Filmed and televised. They performed just five songs: She Loves You, You Can’t Do That, Twist And Shout, Long Tall Sally and Can’t Buy Me Love.
- June 04 Concert at KB Hallen, Copenhagen, Denmark. Jimmy Nicol on drums. Recorded, presumably by Dutch radio.
- June 10 Two performances at the Princess Treatre, Hong Kong. Jimmy Nicol on drums. A recording is said to exist from one of these concerts.
- June 12 Concert at the Centennial Hall, Adelaide, Australia. Jimmy Nicol on drums. Taped for `Beatles Show’, Australian radio programme.
- June 17 Two performances at the Melbourne Festival Hall. Taped for the Australian television programme `The Beatles Sing For Shell’ (incomplete) as well as a radio broadcast (complete).
- July 28 Concert at Johanneshov Ice Hockey Stadium, Stockholm. Recorded in stereo, sadly one channel of the recording is erased.
- August 21 Concert at the Coliseum, Seattle, WA recorded. It’s unclear who taped it, and the recording is pretty bad.
- August 22 Concert at the Empire Stadium, Vancouver, Canada. Recorded by a local radio station and played straight, there is also a second version of the concert with descriptive commentary from one of the station’s reporters.
- August 23 Live concert at the Hollywood Bowl, Los Angeles, California, USA. Recorded by Capitol Records. 6 songs were included on `The Beatles at the Hollywood Bowl’ LP in 1977, leaving 6 further songs unreleased.
- September 02 Concert at the Convention Hall, Philadelphia, PA recorded by WIBG-AM.
- September 03 Concert at the State Fair Coliseum, Indianapolis. Recorded and later broadcast on WIFE-AM.
- September 08 Concert at the Montreal Forum, Montreal, Canada. The chain of ownership for the tape of the concert at 8:30 p.m. — 12 songs in 26 minutes — has been lost in the mists of time.
- October 16 Concert at the A.B.C. Theatre, Hull, England. Privately recorded, probably awful quality. Failed to sell at Christie’s. The only known live recording of I’m Happy Just To Dance with You and I Should Have Known Better.
If a theory regarding EU copyright which claims that only recordings made outside Europe remain unprotected, then only live recordings from outside Europe will be affected. These are owned by whichever radio station recorded them, and if they are now in the pd, no doubt The Beatles themselves will make good use of them in their 2015 The Beatles Live Project – which we are all looking forward to.

When will the Beatles concerts dvd be out? Would be fascinating if they have a version of Day Tripper live besides the rather tame version in Japan in 1966. Other highlights will surely be able to see American tour footage in a clearer format.
I'm really curious to know what's going on at Apple. Last year they obviously thought they needed to release something, so why not this year? My guess is they have a legal plan in place, possibly some precedence to put into play. Maybe they feel they have the financial and legal muscle to drown anyone releasing PD material? Who know. something is up though. They're not stupid.
I don't think an alternate mix of the same recording would indicate a public domain possibility. i.e The Around The Beatles recordings released in stereo on Anthology – are released…and any variant mix ie mono – should not change that. (…besides, the monos were officially released on a video tape). Perhaps I misunderstood the bold / red / italic system…?!?
Very impressive list. What bothers me the most is this: To let this go is very unlike The Beatles and/or McCartney. There MUST be something we don't see or don't know with which they can stop Public Domain releases. One thing that came to mind is that its impossible to release anything with the name Beatles attached to it. If I am not mistaken the name is a registered trademark and cannot be used by any third party. Or can it?
I can't confirm this, but from what I hear, there's a new interpretation of the European copyright law that Apple has embraced. After 50 years, material not released doesn't go into public domain but reverts to the artist instead of the label. The releases by Dylan, the Beach Boys and last year's Beatles release weren't to maintain copyright, but to guarantee the label's rights. Apparently, Apple has made a deal with Universal covering unreleased material that might be issued in the future, thereby making one of those year-end collections unnecessary. That's the story I've heard, at least.
One would think that Jimmy Nichol is rubbing his arthritic hands after reading this.
There are two theories in play:
1. They didn't think that there was enough material to merit a release (as aside from the BBC recordings if only a couple of takes of each studio track were released this would not make for a bumper set. And some of these takes lack vocal anyway).
2. They have reinterpreted the copyright protection in some way and don't think they need to protect these recordings.
Either way, it would be a very brave company to try and make a profit off of these recordings.
@billking: interesting take, and yet the same label released a Beach Boys comp of unreleased material in December.
Assuming what I've heard is correct, the situation with the Beach Boys might be different in that perhaps they have not made a guarantee to Universal of rights to future releases, as Apple supposedly has done.
Apple, etc, have their eye on big sales to the general public. Partially recorded takes of songs is minority interest stuff: the fans who want that sort of thing will already be collecting it. Last year's Bootleg album will become one of those obscure, puzzling Beatle LPs like the Help!/Shell one.
